Terms and conditions
1. Definitions:
"Seller", "we," "us," or "our" refers to Daniel Ahern Books.
"Buyer" refers to the person purchasing our books.
"Goods" refers to any of the books that we sell.
"Website" refers to the Daniel Ahern Books website.
“Other online retailers” refers to other booking selling sites we use to sell our books.
"Antique Shop" refers to the physical retail locations where our books are sold.
"Book Fair" refers to a physical event where our books are sold.
2. General:
These terms and conditions apply to all sales of Goods by the Seller, whether through the website, at book fairs, or in Antique Shops.
By purchasing Goods, the Buyer agrees to be bound by these terms and conditions.
The Seller reserves the right to amend these terms and conditions at any time.
3. Product descriptions and condition:
The Seller makes every effort to accurately describe the Goods.
Due to the nature of second-hand, vintage, and antiquarian books, Goods may exhibit signs of wear and tear, including but not limited to:
Foxing
Tears
Wear to covers and spines
Inscriptions
The Seller will note significant defects in the product description.
Buyers should understand that the description is a subjective view.
Photographs will form part of the description.
Buyers are encouraged to request further information or photographs before purchasing.
4. Pricing and payment:
Prices are as stated on our website, on other websites selling our goods, at book fairs, or in antique shops.
Payment must be made in full before the goods are dispatched (for online sales) or upon purchase (for in-person sales).
The Seller accepts cash, bank transfer, and, if bought online, the payment methods offered by our or others’ websites
5. Online sales and delivery:
The Seller will aim to dispatch goods within threeworking days of receiving payment.
Delivery costs will be clearly stated at checkout.
The Seller is not liable for delays caused by third-party delivery services.
Risk of damage or loss passes to the buyer when the goods are passed to the delivery service.
6. Returns and refunds (online sales):
In accordance with the Consumer Contracts Regulations 2013, the Buyer has the right to cancel their order within 14 days of receiving the goods.
The Buyer must notify the Seller of their intention to cancel in writing.
The Buyer is responsible for returning the Goods in the same condition as received, at their own expense.
The Seller will issue a refund within 14 days of receiving the returned Goods, provided they are in satisfactory condition.
Specific conditions relating to damaged goods during delivery, should also be listed.
7. Returns and refunds (book fairs and antique shops):
Sales made at book fairs and antique shops are generally final.
Returns and refunds may be offered at the Seller's discretion.
The seller is not obliged to offer returns for buyer remorse.
8. Liability:
The Seller's liability is limited to the purchase price of the Goods.
The Seller is not liable for indirect or consequential losses.
Nothing in these terms and conditions excludes or limits the Seller's liability for death or personal injury caused by negligence, or for fraud.
9. Intellectual property:
All content on the Website, including text and images, is the property of the Seller and is protected by copyright.
The Buyer may not reproduce or distribute any content without the Seller's permission.
10. Data protection:
The Seller will comply with the General Data Protection Regulation (GDPR) and the Data Protection Act 2018.
The Seller will only use the Buyer's personal information for the purpose of fulfilling the order.
11. Governing law and jurisdiction:
These terms and conditions are governed by the laws of England and Wales.
Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
